Prime Minister

  • > In a Parliamentary government, the Prime Minister is the real executive.
  • > Although the country's administration is conducted in the name of the President, the President acts only on the advice of the Council of Ministers headed by the Prime Minister.
  • >> In the *Ram Jawaya Kapoor Vs. State of Punjab* case (1955), the Supreme Court ruled that the President is required to act only on the advice of the Central Council of Ministers.
  • >> In the *Shamsher Singh Vs. Government of India* case, the S.C. (Supreme Court) ruled that the President is bound to act according to the advice and suggestions of the Central Council of Ministers.
  • & Dr. B.R. Ambedkar compared the position of the Prime Minister to the "president of america."
  • > Ambedkar described the Prime Minister as the "main pillar" of the "Parliamentary Government building" because of the Prime Minister's key role in the administration of the country.

Head of the Council of Ministers:

  • > The Prime Minister acts as the leader of the Council of Ministers.
  • > R.P. (Rashtrapati/President) appoints ministers based on the P.M.'s advice.
  • > Based on the P.M.'s advice, R.P. allocates portfolios to ministers and can also remove ministers.
  • > The Prime Minister is the chairman of the Council of Ministers meetings.
  • > The P.M. formulates the agenda to be discussed in the meetings.
  • > If the P.M. resigns, the entire Council of Ministers is dissolved.
  • * The P.M. must submit their resignation letter to the President. However, for resignation from Parliament membership, the resignation letter should be given to the presiding officer of the house of which they are a member.

Leader of Lok Sabha:

  • > The P.P. (President probably - should be R.P.) appoints the leader of the party or coalition that has secured a majority in the Lok Sabha as the Prime Minister.
  • > The Central Council of Ministers is collectively responsible to the Lok Sabha, meaning the Prime Minister, who acts as the leader of the Council of Ministers, also leads the House (Lok Sabha).
  • > The President dissolves the Lok Sabha based on the Prime Minister's advice.
  • > If the P.M. is a member of the Rajya Sabha, they can appoint another person as their leader in the Lok Sabha.
  • Current (14th) Lok Sabha Leader: Prahlad Kumar Mukherjee (Note: This seems outdated as current Lok Sabha is 17th)
